Section 53
Family pension and gratuity
(1) If an employee dies while in service or within seven years of receiving pension, his family or his minor brother or unmarried sister will receive gratuity or pension in accordance with section 49 or 50. But in the case of pension, such pension will not be received for more than seven years. The next of kin of an employee who dies before seven years of starting to receive pension will not receive pension after seven years.
(2) Notwithstanding anything written in sub-section (1), if the person receiving pension is a minor, he shall receive such pension until he reaches adulthood.
(3) If the widowed spouse or widowed wife of an employee dies before seven years have passed since his or her spouse is in service or has started receiving pension and is entitled to family pension as per sub-section (1), from the date of payment of such pension period and if he or she does not receive such pension or his or her spouse If the employee dies after seven years have passed since he started receiving pension, he will receive half of the amount of pension he would have received for his entire life from the date of his death. But if such widowed husband or widowed wife remarries, he will not get such pension benefits.
(4) Notwithstanding anything written in sub-section (3), in the event of the death of the widower or widow of the employee receiving pension or if he remarries, the minor children of such employee shall receive the amount of such pension until they reach adulthood.
(5) When the salary of an existing employee is increased, two-thirds of the amount of the increase in the initial salary will be added to the family pension amount received by the person receiving family pension according to sub-sections (1), (2) and (3).
(6) If an employee dies before receiving any amount due under this Act, the person who is determined to receive his pension or gratuity according to this Act among the members of his family will be entitled to receive that amount.
(7) In granting pension or gratuity, the deceased employee shall be entitled to one of the members of his family or his minor brother or unmarried sister.If someone wants it, it will be given to that person and if for some reason the person is unable to get it or if no one wants it, it will be given to a person who is considered appropriate by the committee among the family members of that employee.
